These Terms of Service ("Terms") govern your access to and use of the Buzz app ("App") and related services ("Service") provided by Buzz ("we", "us", or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 13 years old to use the App. If you are between 13 and 17 years old, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. By using the App you represent that you meet these requirements.

2. Account Registration

To access the Service you must create an account. You agree to:

• Provide accurate and complete information during registration
• Keep your login credentials confidential and not share them with others
• Notify us immediately at [email protected] if you suspect unauthorized access to your account
• Maintain only one account per person

You are responsible for all activity that occurs under your account.

3. Description of Service

Buzz provides real-time AI-powered speech-to-text captioning and optional text translation. Key characteristics:

• Transcription and translation are performed by automated AI systems and may contain errors
• The Service is not intended for safety-critical purposes such as medical diagnosis, legal proceedings, emergency communications, or any context where inaccurate output could cause harm
• Buzz is not a professional interpreter or translator service and does not guarantee accuracy
• Features and supported languages may change over time

4. Subscriptions & Billing

Buzz offers the following plans:

Payments

• Subscriptions and prepaid credit packs are purchased through the Apple App Store (iOS) or Google Play (Android)
• We use RevenueCat to manage subscription status and entitlements
• All billing, invoicing, and payment processing is handled entirely by Apple or Google — we never receive or store your payment card details
• Subscription fees are charged to your App Store or Google Play account at confirmation of purchase and automatically renew at the end of each billing period unless cancelled

Cancellation

• Cancel your subscription at any time through the App Store or Google Play account settings
• Cancellation takes effect at the end of the current billing period; you retain access until then
• We do not issue refunds except as required by applicable law or the platform's own refund policies

Credits

Prepaid credit packs are non-refundable and non-transferable once purchased. Credits are tied to your account and expire as stated at the time of purchase.

5. Acceptable Use

You may use the App only for lawful purposes and in accordance with these Terms. You agree not to:

• Reverse-engineer, decompile, disassemble, or attempt to derive the source code of the App
• Use the Service to record, transcribe, or translate conversations without the consent of all participants where required by law
• Transmit any content that is unlawful, harmful, defamatory, obscene, or that infringes any third-party rights
• Attempt to circumvent usage limits, access controls, or billing enforcement
• Use automated scripts or bots to interact with the Service in a manner that degrades performance for other users
• Resell or sublicense access to the Service without our written permission

We reserve the right to suspend or terminate accounts that violate this section.

6. AI & Accuracy Disclaimer

Transcription and translation in Buzz are performed by third-party AI systems (Deepgram, Gladia, Sarvam AI, Google Cloud Speech-to-Text, DeepL, and others). These systems:

• May produce inaccurate, incomplete, or misleading output
• Are not suitable for contexts where precision is essential (medical, legal, emergency, accessibility accommodations required by law, etc.)
• May perform differently across languages, accents, and audio conditions

We are not responsible for errors in AI-generated transcripts or translations. Always verify critical information through appropriate professional channels.

7. Intellectual Property

Our Property

The App, its design, code, trademarks, and all Service-related content (excluding your transcripts) are owned by or licensed to Buzz. Nothing in these Terms transfers any intellectual property rights to you other than the limited license to use the App described herein.

Your Content

You retain ownership of the transcript content generated from your sessions. By using the Service you grant us a limited, non-exclusive license to store, process, and display that content solely to operate and provide the Service to you. We do not use your transcripts to train AI models.

License to Use the App

Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable license to install and use the App on devices you own or control, for your personal, non-commercial use.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT.

We do not warrant that:

• The Service will be uninterrupted, error-free, or available at any particular time
• Transcription or translation results will be accurate or complete
• Defects will be corrected

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL BUZZ BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, LOSS OF PROFITS, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) USD $10.00.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the fullest extent permitted by law.

10. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms or if required by law. You may close your account at any time via the in-app account settings or by contacting us at [email protected].

Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive (Intellectual Property, Disclaimer of Warranties, Limitation of Liability, Governing Law) will continue to apply.

11. Changes to These Terms

We may update these Terms from time to time. We will indicate the date of the most recent revision at the top of this page. Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the App.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States, without regard to conflict-of-law principles. Any disputes arising under these Terms will be resolved in a court of competent jurisdiction in the United States.
